Will of JOHN BELCH

I John Belch of the County of Tuscarawas and State of Ohio, do make and publish this my last will and Testament.
First: It is my will that all my just debts, Funeral Expenses and legal liabilities, be paid out of my Estate.
Second: I give and bequeath to my wife Sarah Belch, in addition to such Items as are allowed to widows by law: (to be sett off by Appraisers, including one years support, and one hundred dollars worth of Personal property, to be selected By my sd wife and appraised by the appraisers of my estate:) a further sum of the interest of one third of All that may Remain of the Proceeds of my Real & personal Estate, after paying legal liabilities, the use or Interest of which said third part, I direct my Trustee hereinafter named, to pay to my sd wife, yearly, during her life, and at her Death, I direct sd one third part to be paid to my heirs & legatee, hereinafter named, in Equal proportions, as the other Two thirds are apportioned.
Third: I give and bequeath to my son Harman Belch one ninth part of the proceeds of my estate, after paying legal liabilities, as aforesaid. To the legal heirs of my Daughter Mary Oliver one Ninth part. To Joseph Belch one Ninth part. To the children of my daughter Nancy Glass, one Ninth part; To the children of my daughter Susanna Conwell one Ninth part; To the children of my daughter Rachel Leget one Ninth part.
To the children of my daughter Elisabeth Herron one Ninth part,
To the children of my daughter Isabel Rigel one Ninth part, and
to my Step-son David Ervin,
In the event that he shall Faithfully Execute this my last will, without any further Charge or fees, one Ninth part, & should the Sd David Ervan, after he may have proceeded to the Settlement of my Sd Estate and before the same may be finally closed be called off by death, any or all unpaid part of Sd one Ninth part, I hereby bequeath to his legal heirs.
I hereby Nominate David Ervan, above named Executor of this my last will and testament, hereby authorising him to Compromise, adjust & settle all Claims due me, And to sell either at Public or private Sale, all my Real Estate, lying in the Township of Warren, County of Tuscarawas & State of Ohio; and Particularly described in Deeds which I hold for said Real Estate, and Deeds to make to purchasers for the same. I further direct my said Executor to pay over Legacies, Share & Share alike, to my Grandchildren above refered to, giving to each their distributive Share of all Dividends, And keeping all the said legatees as nearly equal in their distributive Shares as may conveniently be done, Still Reserving the one third part to be left at Interest for the use of my said wife Sara Belch; And if allowable, I hereby appoint the Sd David Ervan Trustee of Sd one third part. I do hereby Revoke all former wills by me made.

We, Lenord Ray and Isreal S. Lappin being duly sworn in open Court this 24 day of May A.D. 1873, depose and say, that we were present at the execution of the last will and testament of John Belch hereunto annexed; and that we saw the said testator subscribe said will, and heard him publish and declare the same to be his last will and testament; and that the said testator at the time of executing the same, was of full age, and of sound mind and memory, and not under any restraint; and that we signed the same as witnesses at his request, and in his presence, and in the presence of each other,

Be it remembered that in the Probate Court of the County of Tuscarawas, and State of Ohio on the 24th day of May in the year of our Lord, One thousand eight Hundred and seventy three, at the town of New Philadelphia in said County, before W.B. Brown Judge of said Court, among the proceedings then and there had, were the following viz:
In the matter }
of the Will of } The last will and testament of John Belch deceased late of the
John Belch } County of Tuscarawas and State of Ohio, was this day produced in
} Court, and thereupon came Leonard Ray and Israel S. Lappin, the subscribing witnesses to said will and in open Court on Oath testified to the due execution and attestation of said will which testimony was reduced to writing, and by them respectively subscribed, and filed with said will, and it appearing to the Court by said testimony that said will was duly executed and attested, and that the said testator, at the time of executing the same, was of full age, and of sound mind and memory and not under any restraint. It is ordered by the Court that said Will be and the same is hereby admitted to Probate and together with the testimony ordered to be recorded. And thereupon came David Ervin the Executor of said will named and in open Court signified his acceptance of the trust of executing the same. It is therefore further ordered by the Court that letters testamentary be issued to him upon his giving bond in the sum of $19,000.00 Dollars conditioned according to law with James Gracy, George Bradshaw and William Crooks as his Sureties, and all of which has been accordingly so done.

Probably born circa 1800 to 1805. Tradition in Scott County says that Valentine Chastain had a daughter named Sarah Jane. This is probably Sary Shasteen who died in 1847 and is buried at Scaffold Lick, near the road in what seems to be a grave for for a fully grown person.
59 vi. Elizabeth Chastain, born Abt. 1801 in Virginia; died November 20, 1878 in Scott County, Indiana, USA. She married Nathaniel Robbins November 19, 1826; died 1874. He was Church Clerk at Scaffold Lick from July 1830 to March 1847.
60 vii. Mary Chastain, born Abt. 1806 in Kentucky, USA; died Abt. 1838 in Scott County, Indiana, USA. She married Nathaniel Chastain March 16, 1825.
Valentine Chastain performed the marriage between Mary and Nathaniel.. Nathaniel Chastain was probably a son of John and Anner Chastain despite being being listed as an heir of Valentine in 1847. This is based partly on the fact that Anner Chastain was living with Nathaniel in 1850. He is probably named as an heir of Valentine for the estate rights of his children by Mary.

Obituary:
Lloyd "Sunny" James Alderman, 98, died on Saturday, Aug. 26, 2023 at the Oregon Veterans Home in Lebanon, OR.
Funeral services were held on Tuesday, Sept. 5, 2023 at the Hoch Funeral Home in Ainsworth. Pastor Gary Graesser officiated. Musical selections were "Goodbye" by Kenny Rogers and "You're Nobody Til Somebody Loves You" by Dean Martin. Pallbearers were Robert Alderman, Zane Alderman, Zach Lockwood, Adam, Alderman, Bruce Rowley, and Dale White. Honorary Pallbearers were James Alderman, Vance Alderman, Jonn Alderman, Brennan Alderman, Scott Rowley, Brandon Rowley, Vic Young and Bill Young Sr.
Burial was at the Newport Cemetery with military honors by the Newport and Bassett American Legion Posts.
Memorials have been established for the Newport Volunteer Fire Department in Sunny's name. He was a member of the fire department for many years. They may be mailed in care of Hoch Funeral Home, 1320 E. 4th St., Ainsworth NE 69210.
Lloyd was born on Jan. 3, 1925 in Newport to James Russell Alderman and Martha Elizabeth Brown.
Sunny was the grandson of Nebraska pioneers both on his paternal and maternal sides. The Alderman family of Virginia came to Nebraska Territory as some of its first settlers when their uncle Richard Brown,founded historic Brownville in 1854.
In 1890 the Alderman family moved to the fertile Sandhills in north central Nebraska. There the family founded a large hay shipping business. Sunny first began working with his father and uncles in the hay fields when he was seven years old. Later he delivered hay throughout Nebraska and its bordering states, and to contracts the family had with the U.S. Calvary in Ft. Robinson, Nebraska and Ft. Riley, Kansas.
Sunny's nickname came as a result of his big smile and happy nature as a child. His aunts called him "Sunshine" and it was later shortened to "Sunny" by his high school coach.
In 1943 Sunny quit Newport High School in his senior year to join the U.S. Army. He was a medic in the Medical Corp attached to the 1302 Engineers during WWII. In 2018 he was recognized for his service by a Journey of Heroes honor flight to Washington, D.C.
He married Laura May Hutcheson of Bassett on June 15, 1948 in Gering. Soon after their marriage, Sunny and Laura opened Alderman's Market in Newport. Later they moved to Long Pine and then to Chadron where Sunny was an engineer on the Chicago Northwestern Railroad. He was also concurrently a top-selling insurance agent for Bankers Life and State Farm Insurance companies.
In 1970 Sunny became a boilermaker for Combustion Engineering, an international company that developed power generating systems. This took the family to several states including Wyoming, Colorado, Arizona, Kansas, North Dakota, Oregon and Montana. In the mid 1970's, Sunny and Laura also owned Alderman's Thriftway grocery store in Rifle, CO.
Sunny and Laura retired to Newport in 1983. However their retirement meant that they could now busy themselves with civic duties and found two more businesses, Alderman's Sales & Service of TV satellite dishes, and Sunny's Convenience Store & Truck Stop.
They became members of the Newport Action Group and were instrumental in obtaining two Nebraska Economic Development Grants for their small town.
Sunny served as Newport's mayor for 16 years, and Rock County Commissioner for eight years. He served both as mayor and county commissioner for those eight years, as he was elected mayor on a write-in vote. On the state level, Sunny was appointed to the Governor's Advisory Council. He was also a member of committees that developed the recreational Cowboy Trail across Nebraska and obtained federal National Scenic River status for Nebraska's Niobrara River.
In later life, Sunny said that the railroad was his favorite job of his many varied careers. He said, I sometimes sit and wonder how I did it all!
Throughout his 98 years Sunny lived up to his nickname. He was positive, optimistic, generous and good-natured. He never forgot a joke and never met a stranger. It was an endearing family joke that he once had a long conversation with a caller who mistakenly dialed the wrong number. At the Oregon VA Home, he would come out of his room every morning and shout, Good Morning America! before he sat down to work his daily crossword and Sudoku puzzles, or play cribbage, the game he loved the most.
He loved sports and as a younger man pitched baseball. He also loved to fish, especially deep-sea fishing, and regularly took his family to stay at the beach. He loved music, loved to sing and could do a very passable Dean Martin croon. His wife Laura always said that he was a good dancer and all the girls wanted to dance with him during the Big Band era when they grew up. Amazingly he danced until he was 97 years old at the Oregon VA Home dances.
Sunny always told his children Love ya! before he hung up the telephone. And he was so very loved in return. One of his life-long friends said Sunny was the most beloved person that he'd ever met.

He was preceded in death by his wife of 68 years, his parents, his sister Evelyn Alderman Young and his son Chadd Alderman.

I John Belch of the County of Tuscarawas and State of Ohio, do make and publish this my last will and Testament.
First: It is my will that all my just debts, Funeral Expenses and legal liabilities, be paid out of my Estate.
Second: I give and bequeath to my wife Sarah Belch, in addition to such Items as are allowed to widows by law: (to be sett off by Appraisers, including one years support, and one hundred dollars worth of Personal property, to be selected By my sd wife and appraised by the appraisers of my estate:) a further sum of the interest of one third of All that may Remain of the Proceeds of my Real & personal Estate, after paying legal liabilities, the use or Interest of which said third part, I direct my Trustee hereinafter named, to pay to my sd wife, yearly, during her life, and at her Death, I direct sd one third part to be paid to my heirs & legatee, hereinafter named, in Equal proportions, as the other Two thirds are apportioned.
Third: I give and bequeath to my son Harman Belch one ninth part of the proceeds of my estate, after paying legal liabilities, as aforesaid. To the legal heirs of my Daughter Mary Oliver one Ninth part. To Joseph Belch one Ninth part. To the children of my daughter Nancy Glass, one Ninth part; To the children of my daughter Susanna Conwell one Ninth part; To the children of my daughter Rachel Leget one Ninth part.
To the children of my daughter Elisabeth Herron one Ninth part,
To the children of my daughter Isabel Rigel one Ninth part, and
to my Step-son David Ervin,
In the event that he shall Faithfully Execute this my last will, without any further Charge or fees, one Ninth part, & should the Sd David Ervan, after he may have proceeded to the Settlement of my Sd Estate and before the same may be finally closed be called off by death, any or all unpaid part of Sd one Ninth part, I hereby bequeath to his legal heirs.
I hereby Nominate David Ervan, above named Executor of this my last will and testament, hereby authorising him to Compromise, adjust & settle all Claims due me, And to sell either at Public or private Sale, all my Real Estate, lying in the Township of Warren, County of Tuscarawas & State of Ohio; and Particularly described in Deeds which I hold for said Real Estate, and Deeds to make to purchasers for the same. I further direct my said Executor to pay over Legacies, Share & Share alike, to my Grandchildren above refered to, giving to each their distributive Share of all Dividends, And keeping all the said legatees as nearly equal in their distributive Shares as may conveniently be done, Still Reserving the one third part to be left at Interest for the use of my said wife Sara Belch; And if allowable, I hereby appoint the Sd David Ervan Trustee of Sd one third part. I do hereby Revoke all former wills by me made.

It is ordered by the Court that said Will be and the same is hereby admitted to Probate and together with the testimony ordered to be recorded. And thereupon came David Ervin the Executor of said will named and in open Court signified his acceptance of the trust of executing the same. It is therefore further ordered by the Court that letters testamentary be issued to him upon his giving bond in the sum of $19,000.00 Dollars conditioned according to law with James Gracy, George Bradshaw and William Crooks as his Sureties, and all of which has been accordingly so done.
